That directory (....\Data\effect) wasn't created during a normal installation. I validated the files to be certain and that directory still isn't created. The (....\Data) directory exists but no sub-directories contained. Not sure what is going on. Maybe the call in Windows would create the directory and file but I don't know.

P.S. - I launched the game under Win 7 and the sub-directory and file were not present either before launching the game, checking from the main menu while the game is launched and still missing, with a saved game fully loaded and paused still not present, or subsequent to exiting the game. Beginning to seem it is error code that Windows ignores, but not sure.
Found a workaround! The App was listed under a different name at appdb.WineHQ so I missed it the first time (they use Phobos 1953). Anyhow only one of the workarounds listed is required.
Add vcrun2005 using protontricks. ("protontricks 248490 vcrun2005")
In the bug report is mentioned possibly needing a dummy file at ....\Data\effect\full.fx
but in my experience it wasn't needed. I deleted my prefix and after recreation ran the single protontrick command and after that the app runs. The options, loading and quitting all were working as well as video and sound throughout my brief playthrough.
Hope this is of some use and I will post the workaround at ProtonDB in the meantime.
