i mean so if i set cvar gl_vsync to 1 ingame VSYNC is off and if i'll set gl_vsync to 0 it will work.

gl_vsync 1 turns it on, if you turn on gl_vsync then fps_max is ignore. For the report above you must have disabled vsync forcefully in your driver.

gl_vsync = 1 means enable vertical sync, but you can independently tell your video card driver to force it off. So we tell the GL driver please vsync, and it ignore it if you set that setting.

In my video-card settings vsync is diasable, and if i set up gl_vsync to 0 in game, it will activate vsync, but if i'll set up gl_vsync to 1 it will disable vsync. I want to say is that you may make a mistake by adding the values ​​in reverse order.

probably the default setting in driver that came with windows 7 is vsync always off.. updated and works perfectly now.
